Article 1 – Definitions

The following terms are used throughout these Terms & Conditions: Withdrawal period: the timeframe in which a customer is entitled to return an eligible product. Customer: an individual who purchases goods from ByKailea for personal, non-commercial use. Long-term agreement: a contract involving the ongoing delivery of products or services over a specified duration. Right of withdrawal: the customer's entitlement to cancel or return a qualifying order within the designated return window. ByKailea: the online store accessible at https://www.bykailea.com/. Distance contract: a contract entered into between ByKailea and the customer using one or more forms of digital communication, without either party being physically present.

Article 4 – Offers & Product Listings

All products and offers listed on our website are dependent on availability and may be modified or removed at any time without advance notice.

We aim to present product descriptions, pricing, imagery, and stock status as accurately as possible. Slight variations in colour, appearance, or packaging may occur.

Unless indicated otherwise, all prices displayed on our website are listed in Canadian Dollars (CAD).

Article 5 – Agreement Formation

A binding purchase agreement is established once ByKailea has accepted your order and your payment has been successfully completed.

Following your order, you will receive an email acknowledging its receipt. This acknowledgment does not serve as a guarantee of product availability. We retain the right to decline or cancel orders in line with applicable legislation.

Article 6 – Right of Withdrawal

Customers may initiate a return within 30 days of receiving their order.

To be eligible, returned products must be:

Never worn
Completely unused
Not washed
Returned in their original packaging with all tags still attached

Return shipping costs are borne by the customer unless applicable consumer protection law states otherwise.

Article 7 – Refund Process

After a returned item has been received and evaluated, approved refunds will be processed within 5 business days to the original payment method used at checkout.

Refunds are only granted for items that satisfy our return eligibility criteria.

Original shipping fees are non-refundable, except in cases where the return is due to an error on our part.

Article 8 – International Orders, Customs & Import Charges

ByKailea delivers to customers in various countries worldwide.

Orders shipped internationally may incur customs duties, taxes, import fees, brokerage costs, or other charges imposed by the destination country's government.

Unless explicitly stated at checkout, these charges are the sole responsibility of the customer.

ByKailea accepts no liability for delays resulting from customs procedures, import inspections, carrier issues, or actions taken by government authorities.

It is the customer's responsibility to verify that products can be legally imported into their country.

Failure to pay applicable customs charges or refusal to accept delivery does not automatically entitle the customer to a refund.

Article 9 – Payments

All payments are handled securely through reputable third-party payment processors.

By finalizing a purchase, you grant the payment provider authorization to process your transaction using your chosen payment method.

We reserve the right to decline or void orders if fraudulent or unauthorized activity is suspected.

Article 10 – Product Quality & Warranty

We make every effort to ensure our products correspond to their listed descriptions and meet a reasonable standard of quality.

If you receive an item that is defective, damaged, or incorrect, please contact us within 7 days of delivery and attach clear photographs of the issue.

This policy does not cover normal wear and tear, accidental damage, improper handling, or misuse of products.

All estimated delivery timeframes are indicative and should not be treated as guarantees.

Orders are generally processed within 1–2 business days and shipped within the estimated delivery window displayed on our website.

Delays caused by weather events, customs procedures, courier issues, holidays, or other factors outside our control do not automatically qualify for a refund or cancellation.

Once an order has been delivered to the address provided at checkout, the risk of loss transfers to the customer.

To the extent permitted by law, any disputes arising from or related to these Terms & Conditions shall be brought before the competent courts of British Columbia, Canada.

Nothing in these Terms & Conditions restricts or overrides any consumer rights granted under applicable Canadian consumer protection legislation.
